These terms (“AR PD Meter Terms”) govern your use of the AR PD Meter feature. They are supplemental to the ARShades Services — Terms and Conditions of Use (the “General Terms”), which are incorporated by reference and apply to AR PD Meter except as modified below. In case of conflict, these AR PD Meter Terms prevail with respect to AR PD Meter.
1.1 AR PD Meter is a software feature developed by Spaarkly s.r.l. (VAT No. IT02077620769) that provides an estimate of your pupillary distance (PD) — the distance between the centres of your pupils — using your device’s camera and facial landmark detection.
1.2 AR PD Meter may be offered within a Client’s website or application, within ARShades experiences, or as part of an ARShades Mirror experience in-store.
1.3 The measurement is provided for commercial convenience only, to support the selection of eyewear during a digital shopping experience. It is not intended for medical, clinical or diagnostic purposes, nor for the dispensing of prescription lenses (see Section 4).
2.1 The use of AR PD Meter requires your express consent, given by ticking the acceptance box (or an equivalent affirmative action) presented before the measurement starts, together with your permission for camera access.
2.2 Where applicable biometric privacy laws so require (including, for United States users, the Illinois Biometric Information Privacy Act (“BIPA”), the Texas Capture or Use of Biometric Identifier Act (“CUBI”) and Washington RCW 19.375), your affirmative acceptance constitutes your written consent/release to the capture and processing described in Section 3, given before any capture occurs.
2.3 If you do not consent, do not use AR PD Meter. You may still use the other ARShades Services, which do not require this processing.
2.4 The consent flow presented before the measurement identifies the version and date of the AR PD Meter Terms in force and summarises: the data processed, the purpose of the processing, the retention (immediate deletion after processing) and how to withdraw consent. You may withdraw consent at any time by interrupting the measurement or revoking camera access; withdrawal does not affect processing already carried out.
3.1 During the measurement, your camera images are processed on your device to extract derived technical data: facial landmark coordinates, face orientation data and device information. The camera images themselves are not transmitted to, and not stored by, Spaarkly.
3.2 The derived technical data are transmitted, encrypted in transit, to Spaarkly’s backend located in the European Union, where they are used solely to compute and return your measurement, and are permanently deleted immediately after processing. They are not stored beyond processing, and are never sold, leased, traded or disclosed for profit.
3.3 Camera images and video streams are not retained, are not used for biometric identification and are not used to create facial templates. No facial template is created or stored, and the derived technical data are not enrolled in any database used to identify individuals. Consistently with the Privacy Policy, the derived technical data are not used to identify you, are not used for facial recognition, and are not capable, on their own, of identifying you.
3.4 When AR PD Meter is used within an ARShades Mirror experience, the processing takes place on the local backend of the Mirror device, and the data are deleted after processing; no cloud transmission occurs.
3.5 Full details of the processing are provided in the ARShades Privacy Policy (version 5.4 or later), including the regional addenda applicable to your country.
4.1 AR PD METER IS NOT A MEDICAL DEVICE and is not intended to diagnose, treat, cure or prevent any disease or condition, nor to provide medical advice.
4.2 THE MEASUREMENT IS PROVIDED AS AN INDICATIVE ESTIMATE ONLY. Its accuracy may be affected by factors including lighting conditions, camera quality, distance and angle from the camera, facial position, movement, and the wearing of glasses or other items during the measurement.
4.3 THE MEASUREMENT DOES NOT REPLACE A MEASUREMENT PERFORMED BY A QUALIFIED EYE-CARE PROFESSIONAL (such as an optician, optometrist or ophthalmologist). Before purchasing prescription eyewear or making any decision that depends on an accurate pupillary distance, you should have your PD verified by a qualified professional.
4.4 Spaarkly does not warrant the accuracy, completeness or fitness for any particular purpose of the measurement, without prejudice to your Non-Waivable Rights as defined in the General Terms.
5.1 AR PD Meter is intended for users who are at least 18 years old. If you are under 18, you may use AR PD Meter only with the consent and under the supervision of a parent or legal guardian, who accepts these AR PD Meter Terms on your behalf where required.
6.1 To the maximum extent permitted by applicable law, and subject to the carve-outs and the savings clause set out in Sections 12 and 13 of the General Terms, Spaarkly shall not be liable for losses or costs arising from reliance on the measurement — including the purchase of unsuitable eyewear or lenses — where the measurement was used without professional verification as recommended in Section 4.3.
6.2 Nothing in these AR PD Meter Terms excludes or limits any liability that cannot be excluded or limited under applicable law, or affects your Non-Waivable Rights.
7.1 Changes to AR PD Meter or to these AR PD Meter Terms are governed by Section 15 of the General Terms.

These AR PD Meter Terms are drawn up in Italian, which is the authoritative text (terms-ar-pd-meter/it.md). This English version and any other translations are provided for convenience only; in case of discrepancy, the Italian version prevails.
By ticking the acceptance box or using AR PD Meter, you acknowledge that you have read, understood and agree to be bound by these AR PD Meter Terms and by the General Terms, and you provide your express consent to the processing described in Section 3.
